Mandatory Insurance for Hiring Foreign Workers

    • Purpose: Ensures severance pay for foreign workers. Employers are required to enroll within 15 days from the start of the employment contract.

      • Employers hiring foreign workers with more than 1 year of employment period remaining.

      • 8.3% of the foreign worker’s monthly average wage, to be paid monthly

      • Can be claimed by either the foreign worker or the employer in case of employment changes, such as departure (excluding temporary departures).

        Foreign Worker Application Applicable when a worker has been employed at the workplace for more than one year and any of the following situations occur:Change in visa status Permanent departure due to expiration of the permitted stay Death or other employment changes
        For Employers Applicable when a worker has been employed at the workplace for less than one year.
      • If a foreign worker resigns after working for more than 1 year and departs permanently, the employer should report the departure to the Employment Support Center of the Ministry of Employment and Labor and submit the necessary documents to Samsung Fire & Marine Insurance. Claims can also be made after departure.

    • Provides protection against wage arrears. Employers are required to enroll within 15 days from the start of the employment contract.

      • Employers not covered by the Wage Claim Guarantee Act. Employers with fewer than 300 employees at the workplace.

      • Employers must sign an insurance agreement at an employment training institution and pay the insurance fee in cash (via account transfer).

      • Foreign workers must report wage arrears to the Employment Guidance Division of the Ministry of Employment and Labor for verification.

      • Wage arrears must be reported to the Employment Support Center of the Ministry of Employment and Labor. Submit the necessary documents to Seoul Guarantee Insurance to process the claim.

        • Insurance Claim Application Form, worker’s bank account in their name, ID (passport or foreign registration card), Wage Arrears Confirmation.
